    You are right.. I got a call this Wednesday from the Presidents office of initiating an inquiry on my case and again a repeated call from them on Friday that FBI Name Check has been cleared. I forgot to mention this detail in my excitement.

    AFAIK, once you work on EAD, you can not be back on H1B. Please check this with your lawyer.

    However what I do not know, and what my lawyer also could not answer till this point is, if after travelling abroad using AP, can one transfer same H1 to a new employer? I know it is possible to continue working on H1 with the same employer. But what if one need H1 transfer?

    Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.

    6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

    Hi All

    I have been following this thread for the last few days and wanted to share some info. Hoping it would be useful.

    I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.

    We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.

    So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.


    Can you pl update about your second entry via AP, after H-1B transfer. Did you entered successfully.

    Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

    Fight for truth is a difficult thing but when fought with full enthu you will see the results(what ever they might be something positive).



    I don't know what this petition is going to do. Atleast it will convey to CNN top brass that there are people out there who won't tolerate such lies. Maybe it won't do anything now but we must continue our efforts and oppose such false propagation of information whenever we can.

    Outsourcing cannot be stopped with these nonsense bills . Outsourcing can only be stopped when the US market relizes that it is highly overpriced for the same job that is doine abroad for a far lesser price and adjusts accordingly . Every work has a value associated to it and the price needs to be paid according to the value of the work and not the place it is done ( India or the US )

Now the question is , is the barber in the US more skilled than the barber in India , or the Barber in US doing a job if much more value than the barber in India . The reason that the barber is charging more is simply because of the virtue of the fact that he is in the USA and nothig else .

    In the same way the Software Consultants ( Indian or Americans ) who are getting paid more in the USA , pleas remember that the reason for the extra salkary is not because we are more skilled or do better value work . It is simply because of the virtue of being located in the USA and nothing else .

The result will be what hapenned to GM and Ford and Chrysler .These contractors that these companies negotiated with their staff has resulted in their downfall . GM staff drinks beer outside a closed plant and still the UAW contract entiles them to $94.00 per hour . GM and ford though that American consumers will protect them from Honda and Toyota which had much cheaper workes ( on flexible rates ) and made much better cars . The Durbin Grassley amendment will result in the same fate to other american compoanies that happenned to GM and Ford .

    Thank you for the reply. When you say that if I go with Company A that there will be more scrutiny, do you mean they will check the vailidity of the offer and their ability to pay? I work for a Govt. Agency(Company C), they will give me an EVL but I am not sure if they will specify "in accordance with I140". I am actually doing the same job, same place, before as a contractor(Company A) and now as an Employee(Company C).

    This is what you could do. Take the updated EVL letter from your HR/ Supervisor. Attach latest paystubs as additional proof. Now for duties if the EVL does not contain this info then attach a copy of job posting advertisement that was issued when you were hired. Every govt job needs to be advertised. It can be in papers or their own website. Then get the lawyer to draft the AC21 letter and to point out the similarities between this job and your labor.

    Yes, AFAIK the FB spillover is added to the base quota and then divided between the ranks. At least I hope DoS and USCIS don't mess up with this calculation.

    BTW: Where were you able to find this information?


    its clearly written in Sep'2008 bulletin. However, seems like EB3-I wont' get any of it and all numbers will be given to EB2. we loose again.
